Statement of Purpose of Special Meeting- To consider and discuss matters relating
exclusively to the reform of Water District No. 7, necessitated by increased project costs
and related statutory requirements. This meeting is not the final meeting regarding the
reformation of WD 7. It is a notice of intent to revise the existing district resolution
because there is potential for the user rates to increase from $873 annually to $1172 if
we are unable to secure additional funding.
Increased project costs have triggered additional statutory requirements under New
York Town Law, necessitating revision of the existing district resolution and related
approvals.
This meeting is intended to outline the required process and intended path forward; it is
not the final action on reformation.
Overview of Water District No. 7 Cost Increases
• Summary of factors contributing to cost escalation (construction, materials,
financing, and timing impacts).
• Explanation of why the increase exceeds thresholds that require further Board
action, public notice, and hearing under Town Law.
• Clarification that revised costs necessitate reform of the existing district
resolution rather than a continuation under prior approvals.
Discussion of Statutory Process and Intended Path Forward
• Overview of Town Law §§ 209-d and 209-h and why they apply in this
circumstance.
• Explanation of the required sequence: Board resolution → public hearing → posthearing determinations → permissive referendum period.
• Outline of the anticipated timeline, including mandatory waiting periods and
publication requirements, to manage expectations and maintain transparency.
Resolution and Order to Set Public Hearing (Town Law § 209-d)
• Consideration of adopting a Resolution and Order to schedule a public hearing
on the proposed reform of Water District No. 7.
• Proposed public hearing date: February 19 (time-sensitive due to statutory
notice and referendum timelines).
• Discussion of required notice, including publication in the official newspaper and
posting on the Town bulletin board and website.
• Direction to the Town Clerk to coordinate publication and obtain the affidavit of
